MOFCOM announces to initiate a final review investigation on the anti-dumping measures applicable to imported acrylic fibers originating in Japan, South Korea and Turkey

On July 13, 2016, the Ministry of Commerce issued Announcement No. 31 of 2016, deciding to impose anti-dumping duties on imported acrylic fibers originating in Japan, South Korea and Turkey. The implementation period was 5 years from July 14, 2016. Among them, the tax rate in Japan was 15.8%-16.1%, the tax rate in South Korea was 4.1%-16.1%, and the tax rate in Turkey was 8.2%-16.1%. On November 6, 2018, the Ministry of Commerce issued Announcement No. 74 of 2018, adjusting the anti-dumping duty rate applicable to imported acrylic fibers originating in South Korea from 4.1%-16.1% to 8.6%-21.7%. 


On May 12, 2021, the Ministry of Commerce received applications for the final review of anti-dumping measures submitted by Jilin Qifeng Chemical Fiber Co., Ltd., Jilin QiMont Acrylic Co., Ltd., Zhejiang Hangzhou Bay Acrylic Co., Ltd. and Ningbo Zhongxin Acrylic Co., Ltd. on behalf of the Chinese acrylic fiber industry. The applicant argued that if the anti-dumping measures are terminated, the dumping of imported acrylic fibers originating in Japan, South Korea and Turkey may continue, and the damage caused to the Chinese industry may continue, so they ask for the Ministry of Commerce to carry out a final review investigation for imported acrylic fibers originating in Japan, South Korea and Turkey and maintain the anti-dumping measures against imported acrylic fibers originating in Japan, South Korea and Turkey.


In accordance with the relevant provisions of the Anti-dumping Regulations of the People鈥檚 Republic of China, the Ministry of Commerce shall take account of the applicant鈥檚 qualifications, the status of the product under investigation and similar products in China, the import status of the product under investigation during the implementation of anti-dumping measures, the possibility of continued or recurrence of dumping, and the continued or sustained damage. The possibility of reoccurrence and related evidence were reviewed. Existing evidence shows that the applicant complies with the provisions of Article 11, Article 13 and Article 17 of the Anti-dumping Regulations of the People鈥檚 Republic of China on industry and industry representativeness, and is qualified to file an application on behalf of the Chinese acrylic fiber industry. The investigating agency believes that the applicant's claims and the prima facie evidence submitted meet the requirements for the final review of the case. 


According to Article 48 of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce has decided to conduct a final review investigation on the anti-dumping measures applicable to imported acrylic fibers originating in Japan, South Korea and Turkey starting from July 14, 2021. The relevant matters are hereby announced as follows:


I. Continue to implement anti-dumping measures 

According to the recommendations of the Ministry of Commerce, the Tariff Commission of the State Council decided that during the final review of anti-dumping measures, imported acrylic fibers originating in Japan, South Korea, and Turkey will continue to follow the Ministry of Commerce's announcement No. 31 of 2016 and No. 74 of 2018. Anti-dumping duties are levied on the scope and tax rate of taxable products.


1. Japan

Toray Industries, Inc. 16.0%

All Others 16.1%


2. South Korea

Taekwang Industrial CO.,Ltd 8.6%

All Others 21.7%


3. Turkey

Aksa Akrilik Kimya Sanayii A.S. 8.2%

All Others 16.1%


II. Review and investigation period

The dumping investigation period for this review is from April 1, 2020 to March 31, 2021, and the industrial damage investigation period is from January 1, 2017 to March 31, 2021. 


III. Product scope


The scope of the re-examined product is the product to which the original anti-dumping measures are applied, and is consistent with the product scope of the Ministry of Commerce's 2016 Announcement No. 31, as follows:


Product name under investigation: Polyacrylonitrile fiber, or Acrylic fiber.


The product is listed under tariff numbers of 55013000, 55033000, 55063000 in the Customs Import and Export Tariff of the People's Republic ofChina. Modified acrylic fiber (modified polyacrylonitrile fiber) under the above tax code is not within the scope of the products under investigation.


IV. Review content

The content of this review investigation is: If the anti-dumping measures on imported acrylic fibers originating in Japan, South Korea and Turkey are terminated, whether it may lead to the continuation or recurrence of dumping and damage.  

 

V. Investigation period

The investigation started on July 14, 2021 and should end before July 13, 2022.
